!important;margin-top:0px;margin-bottom:0px;">在现实生活中，也存在很多债务人确实有一定的困难，导致短时间内无法还清债款。但是他们的内心是很真诚的，他们也不想被债权人一直追着要钱。那么对于这一类人，他们属于“老赖”吗？<p !important;margin-top:0px;margin-bottom:0px;">其实，根据上面的规定可以看出，并不是所有的债务人都会定位“失信被执行人”的。按照我国的《民法通则》规定：债务应当清偿。暂时无力偿还的，经债权人同意或者人民法院裁决，可以由债务人分期偿还。<p !important;margin-top:0px;margin-bottom:0px;">进入强制执行程序，法院查清债务人名下是否有可供执行的财产，或者债务人也可证明自己确实暂时没有能力偿还债务。法院认定债务人确实无能力偿还的标准是：通过查询债务人名下的存款、土地、房产、车辆、投资（股权）、股票等财产，没有发现有可供执行的财产。<p !important;margin-top:0px;margin-bottom:0px;">偿还债务，履行法定义务，一要看能力，二要看态度。如果法院认为是老赖一般都是具有相应的偿还能力，而不积极履行偿还义务的人。<p !important;margin-top:0px;margin-bottom:0px;">如果真是丧失了偿还能力，法院通过执行与查询没有可执行财产，不属于老赖，可以向法院说明情况取得法院的认可一般不会列入失信人名单的（即列入也没有任何惩戒性作用）。
